Welcome to Dawn Bradbury Design. These Terms of Service ("Terms") govern your access to and use of www.dawnbradburydesign.com (the "Site") and any purchase you make from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
The Site is operated by Dawn Bradbury LLC ("we", "us", "our").
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from the Site. By placing an order you confirm that you meet this requirement and that the payment method you use belongs to you or that you are authorised to use it.
2. Our Products
Every Dawn Bradbury Design piece is made from curated artwork and printed onto mulberry silk. Because of this, please note the following, which are characteristics of the product rather than defects:
Print placement varies. Each garment is cut individually from printed yardage. The exact position of the print on your piece will differ from the piece shown in our photography and from other pieces of the same design. No two are identical.
Colour varies between screens. We photograph our pieces carefully, but the colour you see depends on your device, its display settings and your lighting. We cannot guarantee that the colour on your screen exactly matches the finished garment.
Fabric and finish. Slight irregularities in weave, hand-finishing and hem are inherent to the materials and construction and are not considered faults.
Sizing. Our pieces are cut to one generous size unless otherwise stated. Measurements provided in the Sizing Guide are approximate and may vary slightly between garments.
We reserve the right to modify, discontinue or limit the availability of any product at any time without notice.
3. Pricing and Payment
All prices are listed in USD and exclude taxes, shipping and any applicable duties unless expressly stated.
We reserve the right to correct pricing errors, including after an order has been submitted. If a product's correct price is higher than the price shown, we will contact you before dispatch to confirm whether you wish to proceed or cancel for a full refund.
Payment is taken at the time of order. We accept the payment methods displayed at checkout. By submitting payment details you represent that you are authorised to use the payment method provided.
4. Orders and Acceptance
Your order is an offer to purchase. We accept it when we dispatch the goods and send you a confirmation of shipment. Order confirmation emails acknowledge receipt but do not constitute acceptance.
We may refuse or cancel any order at our discretion, including where:
- the product is unavailable or out of stock;
- there is an error in the price or product description;
- we suspect fraudulent, abusive or unauthorised activity;
- we are unable to fulfil delivery to your address.
If we cancel an order after payment has been taken, we will refund you in full.
5. Shipping and Delivery
We ship to the United States and internationally.
Delivery estimates are estimates, not guarantees. We are not liable for delays caused by carriers, customs, weather or other events outside our control.
Risk of loss passes to you on delivery to the carrier. Title passes on receipt of full payment.
International orders may be subject to import duties, taxes and customs fees levied by the destination country. These are your responsibility and are not included in the price or shipping charge. We are not able to predict or reimburse these charges. Refused parcels returned to us due to unpaid duties will be refunded less shipping and any costs incurred.

6. Returns and Exchanges
Our returns process, timeframes and conditions are set out in full in our Shipping & Returns policy, which forms part of these Terms.
Sale items, final sale items and made-to-order pieces are not eligible for return or exchange except where the item is faulty.
Nothing in these Terms limits any statutory rights you may have in respect of faulty or misdescribed goods.
7. Intellectual Property
All artwork, prints, patterns, designs, photography, text, logos and other content on the Site are the property of Dawn Bradbury LLC or its licensors and are protected by copyright, trademark and other intellectual property laws.
You may not, without our prior written permission:
- reproduce, copy, adapt or create derivative works from our prints, patterns or artwork;
- use our images, product photography or artwork for commercial purposes;
- manufacture, distribute or sell goods bearing our designs;
- use our name, logo or trademarks in any way likely to cause confusion.
You may share our product images on social media for personal, non-commercial purposes provided you credit Dawn Bradbury Design and do not alter the images.
8. Your Use of the Site
You agree not to:
- use the Site for any unlawful purpose or in breach of these Terms;
- attempt to gain unauthorised access to the Site, its servers or related systems;
- introduce viruses, malware or other harmful code;
- scrape, data-mine or systematically extract content from the Site;
- interfere with or disrupt the operation of the Site;
- impersonate any person or misrepresent your affiliation with any person or entity.
We may suspend or terminate your access to the Site at any time for breach of these Terms.
9. Reviews, Comments and Submissions
If you submit reviews, comments, photographs or other content to us or to our social channels, you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, modify and display that content in connection with our business, including in marketing.
You represent that you own or control the rights to any content you submit and that it does not infringe the rights of any third party.
We may remove any submitted content at our discretion.
10. Third-Party Links and Services
The Site may contain links to third-party websites and uses third-party services for payment processing, shipping and analytics. We are not responsible for the content, policies or practices of third parties. Your use of those services is governed by their own terms.
11. Disclaimers
The Site and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that the Site will be uninterrupted, secure or error-free, or that defects will be corrected.
12. Limitation of Liability
To the fullest extent permitted by law, Dawn Bradbury LLC, its officers, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data or goodwill, arising from your use of the Site or any product purchased from us.
Our total aggregate liability arising out of or relating to these Terms or any product shall not exceed the amount you paid for the product giving rise to the claim.
Some jurisdictions do not permit the exclusion or limitation of certain warranties or liabilities. Where this applies, the above limitations apply only to the extent permitted by law, and nothing in these Terms excludes liability for death or personal injury caused by negligence, or for fraud.
13. Indemnification
You agree to indemnify and hold harmless Dawn Bradbury LLC and its officers, employees and agents from any claim, demand, loss or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Virginia, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Powhatan, Virginia, and you consent to the jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms at any time. The revised version takes effect when posted to the Site, and the "Last updated" date will change accordingly. Your continued use of the Site after changes are posted constitutes acceptance. We recommend reviewing these Terms periodically.
16. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full force.
These Terms, together with our Privacy Policy and Shipping & Returns policy, constitute the entire agreement between you and us regarding your use of the Site.
